61. IGA WITH THE CITY OF MESA FOR RIGHT-OF-WAY ASSISTANCE FOR SIGNAL BUTTE ROAD FROM WILLIAMS FIELD ROAD TO PECOS ROAD Approve the Intergovernmental Agreement between Maricopa County (County) and the City of Mesa (City) for assistance in acquiring right-of-way and related easements within County’s jurisdiction; authorize the County’s Legal Representative to perform all acts in the manner required by law to condemn property necessary for the City’s project. The purpose of this Intergovernmental Agreement is to identify and define the respective roles and responsibilities of the County and the City for the project, including rights-of-way acquisition and annexation of the project and project area. The City is currently developing a project to improve Signal Butte Road, from Williams Field Road to Pecos Road (Project). The City is currently seeking Real Estate Support from the County to acquire right-of-way and related easements within the County’s jurisdiction related to the City’s project. Arizona State Statue §§ 9-241 prohibits Cities and Towns from acquiring right-of-way within the jurisdictional boundaries of the County. The City will reimburse the County for all costs associated with the right-of-way acquisition. When completed, the City’s project will consist of two travel lanes and align with the Arizona Department of Transportation‘ s future improvements for State Route 24. The terms of the agreement are in effect as of Board of Supervisors approval and shall remain in full force and effect until all stipulations have been satisfied, except that it may be amended upon written agreement by both parties.
