95. AMENDMENT TO IGA WITH THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY FOR SUN CITY WEST AREA CHANNEL CROSSINGS PROJECT Approve the First Amendment to the Intergovernmental Agreement (C-64-20-0167-M-01) between Maricopa County (County) and the Flood Control District of Maricopa County (FCDMC) to collaborate on mutually beneficial, channel-area improvements in Sun City West Area Community. This First Amendment aims to amend the 2021 Intergovernmental Agreement (IGA) to revise the responsibilities of the FCDMC and County for the project, including the design, construction, permitting, and cost-sharing. The funds are budgeted for FY2023 Transportation Department (640) Transportation Capital Project Fund (234) Transportation System Management Project, sub-project TT0615. The revised estimated construction cost is $6,038,000. The County’s estimated cost-share contribution is $3,622,800 and the FCDMC’s estimated cost-share contribution is $2,415,200. Under the original agreement FCDMC contributed $2,000,000 upon completion of design of the project. Upon start of construction FCDMC will contribute the balance. This First Amendment changes the financial terms of the 2021 IGA, and this First Amendment shall supersede and replace the previous terms in the original agreement. Accordingly, the IGA shall become effective on the date approved by both the County Board of Supervisors and the District’s Board of Directors and remain in full force and effect until all stipulations are met.
