59. IGA WITH CITY OF PHOENIX TO ACCEPT 5307 GRANT FUNDING TO IMPROVE LOWER BUCKEYE ROAD FROM 125TH AVENUE TO EL MIRAGE ROAD Approve the Intergovernmental Agreement between Maricopa County and the City of Phoenix to accept 5307 Grant Funding to improve Lower Buckeye Road from 125th Avenue to El Mirage Road. The Federal Award Identification Number (FAIN) No. AZ-2021-049 is designated to the city of Phoenix for distribution to other entities based upon transit needs in the region. Maricopa County is responsible for accessibility to transit stops on roads owned and operated by MCDOT. This one-time pass-thru grant is designated to provide ADA facilities to two transit stop locations. Under this Intergovernmental Agreement, the Board of Supervisors will authorize the Maricopa County Director of Transportation, or her designee, to accept federal grant funds for $140,000, as a pass-through from the City of Phoenix Public Transit Department. Lower Buckeye Road from 125th Avenue to El Mirage Road is a Maricopa County maintained road in an unincorporated strip of land bordered by the City of Avondale on the north, south, and east. There are two bus stops in this segment serving the Avondale Zoom through the Valley Metro Regional Public Transportation Authority and are identified in the MCDOT ADA Transition Plan. The County will improve the segment by adding sidewalk, curb and gutter, and ADA ramps to meet the 2010 ADA Accessibility Standards. The Americans with Disabilities Act of 1990 requires accessible routes to all public facilities. This grant provides funding to install sidewalks to two transit stops along Lower Buckeye Road that are identified in the MCDOT ADA Transition Plan. The County will lead the efforts to design and construct the sidewalk, curb, and gutter. The total amount of the improvements is $175,000. The County will be financially responsible for $35,000 of the local match of the 5307 Grant funds budgeted in FY2022 Transportation Department (640) Transportation Capital Project Fund (234) Five Year Program in the Transportation System Management Project, sub-project TT0700. The grant will fund the remaining $140,000. This was non-competitive bid process. The transit stops are located within MCDOT rights of way and any and all improvements are the sole responsibility of MCDOT. Work will be done utilizing a Jobs on Contract agency which was established through a competitive process. Indirect costs are not refundable. Any indirect cost will be funded through the Transportation Improvement Program, TMAN bin. There are no ongoing contributions related to the grant. Routine sidewalk maintenance will be performed as part of regular roadway maintenance and covered by the Operation Budget. Grant revenues are not local revenues for the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The approval of this requested action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. Section 42-17105. The terms of the agreement are in effect as of the Board of Supervisors' approval and shall remain in full force and effect until all stipulations have been satisfied, except that it may be amended upon written agreement by all parties.
