75. IGA WITH THE CITY OF CHANDLER FOR RIGHT-OF-WAY ASSISTANCE FOR LINDSAY ROAD (OCOTILLO ROAD TO HUNT HIGHWAY) Approve the Intergovernmental Agreement between Maricopa County (County) and the City of Chandler (City) for assistance in acquiring right-of-way and related easements within County’s jurisdiction and authorize the Co unty’s Legal Representative to perform all acts in the manner required by law to acquire, including condemnation, the property necessary for the City’s roadway improvements to Lindsay Road from Ocotillo Road to Hunt Highway (Project). The purpose of this Intergovernmental Agreement is to identify and define the respective roles and responsibilities of the County and the City related to the Project, including rights-of-way acquisition and annexation of the project area. Pursuant to ARS §§ 9-241, the City i s seeking Real Estate support from the County to acquire right-of-way and related easements within unincorporated Maricopa County required for the Project. The City will pay for all costs associated with the right-of-way acquisition. The proposed improveme nt will complete the minor arterial standard in places it was not finished during development. The improvements will include four vehicular travel lanes (two lanes in each direction), raised medians, bike lanes, curb, gutters, sidewalks, ADA ramp upgrades, traffic signal upgrades, street lighting, undergrounding SRP 12kV, drainage improvements, landscaping, dual left turn lanes at Riggs Road, water, sewer and private utility improvements. The Intergovernmental Agreement requires the City to annex the Projec t upon completion. Supervisory District No. 1 (C-64-22-213-X-00)

67. AMENDED AND RESTATED IGA WITH CITY OF CHANDLER FOR RIGHT-OF-WAY ASSISTANCE FOR LINDSAY ROAD FROM OCOTILLO ROAD TO HUNT HIGHWAY Approve the Amended and Restated Intergovernmental Agreement between Maricopa County (County) and the City of Chandler (City) for assistance in acquiring right-of-way and related easements within County’s jurisdiction and authorize the County’s legal representative to work in cooperation with the City to contract with outside Counsel to perform all acts in the manner required by law to acquire, including condemnation, the property necessary for the City’s roadway improvements to Lindsay Road from Ocotillo Road to Hunt Highway. The City is seeking streamlined Real Estate support from the County to acquire right-of-way and related easements within unincorporated Maricopa County required for the Project. The City will pay for all costs associated with the right-of-way acquisition, including condemnation costs. The proposed improvement will complete the minor arterial standard in places not completed by private development. The improvements will include four vehicular travel lanes (two lanes in each direction), raised medians, bike lanes, curb, gutters, sidewalks, ADA ramp upgrades, traffic signal upgrades, street lighting, undergrounding SRP 12kV, drainage improvements, landscaping, dual left turn lanes at Riggs Road, water, sewer, and private utility improvements. The Intergovernmental Agreement requires the City to annex the Project upon completion. The City will be authorized to hire outside counsel, on behalf of the County, for condemnation cases. While the majority of the work will be done by the City and outside counsel, settlement agreements will still need to be approved by the Board of Supervisors.
