107. IGA WITH CITY OF MESA FOR THE IMPROVEMENTS TO UNIVERSITY DRIVE FROM POWER ROAD TO HIGLEY ROAD Approve the Intergovernmental Agreement between Maricopa County (County) and the City of Mesa (Mesa) for the Improvements to University Drive from Power Road to Higley Road. Under this Intergovernmental Agreement, the County will act as the lead agency for all aspects of the design and construction of the Project, which will be completed to County and City standards. The County operates and maintains University Drive. The County proposes to upgrade ADA ramps, sidewalks, driveways, bus stops, and signal equipment on University Drive from Power Road to Higley Road to meet 2010 ADA standards. The work also includes the relocation of existing waterline and wastewater facilities, including hydrants, manholes, and valves, which are owned and maintained by the City's Water Resources Department. The County will be financially responsible for the construction cost of the Project, which is currently estimated at $3,500,000. The funds are budgeted in FY2023 - 2024 Transportation Department (640) Transportation Capital Project Fund (234) Five–Year Program in the Transportation System Management Project, sub-project TT0612. Construction is planned for fiscal years 2023 - 2024. The City will be responsible for the waterline relocation improvements and will contribute $22,000 towards the construction cost. The County will continue to maintain the road after the Project is complete. The City will retain responsibility for the operation and maintenance of the relocated waterline improvements. The terms of the agreement are in effect as of the Board of Supervisors' approval. They shall remain in full force and effect until all stipulations have been satisfied, except that it may be amended upon written agreement by all parties. 49. AMENDMENT TO IGA WITH CITY OF MESA FOR THE IMPROVEMENTS TO UNIVERSITY DRIVE FROM POWER ROAD TO HIGLEY ROAD Rescind the July 27, 2022 approval by the Board of Supervisors (for the improvements of University Drive from Power Road to Higley Road C-64-23-006-X-00); and approve a revised version. The action requested above is because, after the Board took its July 27, 2022 action to approve the Intergovernmental Agreement for the improvements of University Drive from Power Road to Higley Road. The City requests that no-cost permitting language be removed from the Agreement. Therefore, the County and its contractors will pay for permits related to the construction of the improvements. Thus, paragraph 10.3 of the intergovernmental Agreement is amended to "Issue to the County permits to work within the incorporated limits of the City or on City facilities will be issued to the County or its contractor subject to submission of the appropriate application and payment of generally applicable fees." All other terms of the Agreement will remain with the Board of Supervisors' approval. They shall remain in full force and effect until all stipulations have been satisfied, except that it may be amended upon written Agreement by all parties.
