46. AMENDMENT TO IGA WITH CITY OF AVONDALE FOR 115TH AVENUE BRIDGE OVER THE GILA RIVER AT THE PHOENIX INTERNATIONAL RACEWAY Approve Amendment No. 1 to the Intergovernmental Agreement (IGA) between Maricopa County and the City of Avondale to extend the annexation period for the 115th Avenue Bridge over the Gila River at the Phoenix International Raceway for an additional five years. The original Intergovernmental Agreement was entered into on September 11, 1997 (C-64-98-060-2-0). The State of Arizona, who was a partner in the original Agreement, has met all of its contractual obligations under the original Agreement and therefore, it is the opinion of the Arizona Attorney General’s Office that this First Amendment may be executed only between the County and the City. The original Agreement required the County to own, maintain and be responsible for the Bridge for a period of 12 years after the Bridge project was completed. At the end of the 12 year period, which was August 10, 2011 the City was required to initiate annexation of the Bridge into its corporate limits. The City has begun the preliminary work necessary to annex the Bridge. The City and the County agree and understand that the annexation process for the Bridge involves fragmented parcels and State Land, which may cause challenges to completing the annexation. The City is willing to share the costs to operate and maintain the Bridge, including the federally mandated inspections, until it is able to complete the annexation process. The City shall diligently pursue such annexation to completion, which completion shall not be later than August 10, 2016 (Annexation Deadline). Supervisory District No. 5 (C-91-12-071-M-00)
