L-1. WHITE TANK BRANCH LIBRARY PROJECT Public notice, legal advertisement, and contract award process for the construction of the White Tank Branch Library. Presenters: Harry R. Courtright, Director, Library District and Akram Rosheidat, T.R.K. Architecture and Facilities Management, Inc. Authorize the public notice, legal advertisement and award of a contract to the best qualified design-build team for the construction of the White Tank Branch Library provided the guaranteed maximum price is not more than ten percent (10%) over the independent estimate. The source of funding for this expenditure is accumulated fund balance. Also, authorize the Chairman of the Library Board of Directors to sign the necessary documents. This is a sealed competitive selection procurement process to be conducted in accordance with the Maricopa County Procurement Code, Article 5, Section MC1-504.E Design-Build and Article 5 Procurement Procedures Manual, Chapter III. The White Tank Branch Library will be a 30,000 sq.-ft. building just west of the intersection of Olive Avenue and Perryville Road in unincorporated Maricopa County . This project will provide public library service to the areas just east of the White Tank Regional Park . MAG projections show the library's 5-mile radius will be home to 48,800 residents in 2010 and 89,800 residents by 2020. A key project goal is to deliver a LEED certified green building in accordance with the Board's environmental initiatives. (C-65-09-005-5-00)

IGA BETWEEN THE MARICOPA COUNTY LIBRARY DISTRICT AND MARICOPA COUNTY Approve the Intergovernmental Agreement between Maricopa County (“County”) and the Maricopa County Library District (“District”) that will allow the Parks Department to provide land in the White Tank Mountains Regional Park preserve where the District will build a library and Park Nature Center. The term of this Agreement shall commence on the effective date and shall expire 25 years thereafter with one 25 year renewal option. There is no financial impact. The County will provide the District with the land. The District will pay the expense of construction of the building, including the 3,300 sq. ft. space for the Park Nature Center. The Board approved the construction of the White Tank Branch Library on September 15, 2008 (C-65-09-005-5-00). A corresponding agenda item can be found under C-65-09-020-M-00. (C-30-09-033-3-00)

LA-1. CAPITAL PROJECT INCREASE AND RECONCILIATION FOR WHITE TANK BRANCH LIBRARY Approve a new project total multi-year appropriation (inception to completion) for the White Tank Branch Library Capital Project (LDB1) at $11,000,000. This action is necessary to accommodate early procurement of the Furniture, Fixtures and Equipment and the Opening Day Collection of Library Materials. The original project established by in the FY09 Annual Business Strategies was $9,693,000. When the project was brought forward via an agenda 9/15/08 (C-65-09-005-5-00) it was presented with a project total of $9,193,000. During the FY10 budget recommendation project, the total was increased by $407,000, and reflected actual expenditures in FY09 of $675,537. The project total in the FY10 Annual Business Strategies is reflected as both $9,600,000 and $10,500,000. The Expenditure authority for FY10 is $9,600,000 and does not need to be revised at this time. This action reconciles the project total a final project amount of $11,000,000. A cash/fund transfer reconciliation will be completed as part of the FY11 budget preparation. The project is expected to be complete during FY11. (C-65-09-005-5-01)

L-6. CHANGE ORDER TO WHITE TANK LIBRARY CONSTRUCTION CONTRACT WITH MORTENSON CONSTRUCTION (LDB2) Approve the deductive Change Order to the White Tank Library construction contract with Mortenson Construction (LDB2) for reducing the scope and price. The purchase and installation of Photovoltaic (PV) Panels and the automated shades are removed from the contract. The Guaranteed Maximum Price is reduced by $486,176. (C-65-09-005-5-03)

L-7. ADMINISTRATIVE CORRECTION REGARDING CONSTRUCTION CONTRACT WITH MORTENSON CONSTRUCTION Approve an administrative correction to clarify the action taken by the Board on June 23, 2010 agenda C-65-09-005-5-02 (LDB3), regarding a construction contract with Mortenson Construction for the purchase and installation of Photovoltaic Panels and automated shades in the White Tank Library. The contract is in the guaranteed maximum price of $608,095. The term of the contract is from June 23, 2010 to October 31, 2010. (C-65-09-005-5-04)
