76. AMENDMENT TO RESOLUTIONS FOR ACQUISITION OF LAND RIGHTS FOR IMPROVED ACCESS TO EXISTING STRUCTURES AND PROJECT AREA PROPERTIES Adopt Resolution FCD 2009R002B, an amendment to previous resolutions numbered FCD 2009R002 and 2009R002A, for the acquisition of land rights and for the construction of road improvements to provide improved legal access to existing structures and project area properties for the Flood Control District of Maricopa County (District). This amendment includes all structures and areas operated and maintained by the District rather than limit the authorization to a specific list of structures. The District operates and maintains flood control structures and properties within and without Maricopa County that protect the residents of Maricopa County from flooding. Several of these structures lack adequate access for operation and maintenance. In some cases, this lack of legal access has been exacerbated by new and on-going development. The Board previously authorized the District to acquire rights-of-way for additional access for specific structures under resolutions FCD 2009R002 dated March 18, 2009 (C-69-09-052-6-00) and FCD 2009R002A (C-69-09-052-6-01) dated February 10, 2010. District staff have identified several more structures and properties operated and maintained by the District that require additional access. The acquisition of additional rights-of-way and construction of road improvements for operations and maintenance access will require expenditure of both District operating funds and capital improvement program funds. This amendment expands the previous authorizations to acquire additional access to include the ACDC and Cave Creek Arm, Apache Jct. FRS and Floodway, Buckeye FRS #1 #2 #3, Bulldog Floodway, Dreamy Draw Dam, Harquahala Dam FRS, East Valley Drains, Hermosa Vista-Hawes Rd., Loop 303 Outfall Drainage System, IBW Outlet Channel, New River Channelization, Old Cross Cut Canal, Perryville Bank Stabilization, Reems Rd Channel, Rittenhouse Rd Drain and Basin, Salt River Channel, Scatter Wash, Sonoqui Wash, Signal Butte Floodway, Skunk Creek, Sossaman Rd Drain, Vineyard FRS, and Tres Rios Levee; all District maintained properties and structures and adds authority for the expenditure of operating funds in addition to previously authorized capital improvement program funds. Individual land acquisitions will be subject to the ratification and approval of this Board. This Agenda Item impacts all supervisory districts. (C-69-09-052-6-02)
