F-1. AMEND RESOLUTION REGARDING POWERLINE FLOOD RETARDING STRUCTURE FISSURE RISK ZONE MITIGATION PROJECT Adopt Amendment No. 1 to Resolution FCD 2008R015 for the Powerline Flood Retarding Structure (FRS) Fissure Risk Zone Mitigation Project (PROJECT [#310]). This Amendment No. 1 authorizes and directs the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to negotiate and prepare intergovernmental agreements and/or agreements with the United States, the State of Arizona, other municipalities, agencies and others, as appropriate, for cost sharing, design, construction, construction management and future operation and maintenance of the PROJECT, including appropriate District participation in landscape and multi-use improvements, subject to the ratification and approval of this Board. Powerline FRS is one of a system of three flood retarding structures the District has identified a need to fully rehabilitate or replace. This system provides significant flood control and erosion protection of public infrastructure, residential, commercial and agricultural land within Maricopa and Pinal Counties. The PROJECT will implement interim dam safety measures required for the operation of the Powerline FRS. On April 1, 2009, under Resolution FCD 2008R015 (C-69-09-056-6-00), the District authorized the negotiation of engineering and construction contracts, the budgeting of funds and the conduct of permitting activities to implement the Project, subject to Board authorization and approval. The District has identified the United States Department of Agriculture Natural Resources Conservation Service as a potential source of supplemental funding for the PROJECT and intends to negotiate agreements to obtain that funding. This Amendment No. 1 authorizes that negotiation process. This Agenda Item impacts Supervisory District 1. (C-69-10-060-6-00)

F-2. IGA WITH NATURAL RESOURCES CONSERVATION SERVICE FOR POWERLINE FRS FISSURE RISK ZONE MITIGATION PROJECT Approve Intergovernmental Agreement (IGA) FCD 2010A002 for the Powerline Flood Retarding Structure (FRS) Fissure Risk Zone Mitigation Project (Project[#310]) between the Natural Resources Conservation Service (NRCS) and the Flood Control District of Maricopa County (District). This IGA establishes the cost-share for the design, land acquisition, construction, and operation and maintenance of the Project. NRCS will pay for 100% of the NRCS eligible construction costs. The District will pay for the design, construction management, land acquisition and operation and maintenance. The estimated total eligible Project construction cost is $5,000,000, paid entirely by NRCS. The District will be responsible for funding Project design and non-eligible construction cost, estimated to be $1,289,000. The IGA shall become effective when signed by NRCS and shall expire five years from the date of signing by NRCS. Powerline FRS is one of a system of three flood retarding structures (Powerline FRS, Vineyard Road FRS and Rittenhouse FRS) that were constructed by the U.S. Soil Conservation Service (now Natural Resources Conservation Service or NRCS). Powerline FRS was constructed in 1967 and 1968. The structure was constructed with federal assistance under the PL-566 Watershed Protection & Flood Protection Act. The District operates and maintains the structure and is the local sponsor for this Project. District staff identified a fissure risk zone associated with the structure, and near term action is required to mitigate the associated dam safety and public safety concern. In July 2008, the District submitted this Project to the District's Capital Improvement Program Prioritization Procedure for fiscal year 2009-2010, and the District’s Flood Control Advisory Board, with staff concurrence, recommended the project for future implementation. In January 2009, the Board of Directors adopted Resolution 2008R015 authorizing and directing the Chief Engineer and General Manager to proceed with the Project. The Resolution was amended on April 6, 2009 (C-69-09-056-6-00) authorizing an Intergovernmental Agreement between NRCS and the District. The District has initiated final design, and construction is anticipated to begin by early 2011. This Agenda Item impacts Supervisory District 1. (C-69-11-003-3-00)
