F-13. MAINTENANCE AGREEMENT WITH THE CITY OF TEMPE REGARDING HABITAT RESTORATION AREA IN THE INDIAN BEND WASH Approve a maintenance agreement between the City of Tempe (City) and the Flood Control District (District) regarding the maintenance of Tempe’s Habitation Restoration Area in the Indian Bend Wash. Such an agreement establishes the duties of maintenance activities in the Indian Bend Wash Habitat area and saves the District time and monies by clarifying duties of each agency. This agreement is effective upon filing with the Maricopa County Recorder and shall remain in full force and effect for the same duration of the Easement C2003-32, recorded April 14, 2003, Recorder No. 2003-0460494. The Flood Control District granted the City of Tempe a habitat easement in 2003 (C2003-32) which obligated the City of Tempe to operate and maintain a habitat restoration in accordance with the US Army Corps of engineer requirements. The easement referred to operation and maintenance of the habitat area. In order to define the exact maintenance requirements, an operation and maintenance agreement was necessary. (C-69-10-052-3-00)
