F-5. IGA WITH ARIZONA DEPARTMENT OF TRANSPORTATION FOR THE SR303L DRAINAGE IMPROVEMENTS Approve Intergovernmental Agreement (IGA) FCD 2007A005 for the SR 303L Drainage Improvements (Project [#470]) between the Arizona Department of Transportation (State) and the Flood Control District of Maricopa County (District). This IGA is for cost sharing of the Project design, right-of-way acquisition, construction, construction management and operation and maintenance. The estimated cost of the IGA to the District is $28,235,000. The IGA shall become effective upon signing and dating of the Determination Letter by the State Attorney General and shall remain in effect until completion of the construction of the Project. Operation and maintenance terms of the IGA shall survive the expiration of the IGA. The SR 303L/White Tanks Area Drainage Master Plan (ADMP) was developed in 1995 and updated in 2005 (ADMPU) to identify and develop solutions to mitigate flooding hazards in the White Tanks drainage area. The ADMPU recommended the construction of a regional 100-year drainage system adjacent to the SR 303L to intercept storm water flows and provide an outfall to the Gila River. The drainage features consist of 19 miles of channel and associated basins from Clearview Boulevard to the Gila River along the proposed SR 303L alignment. The District will fulfill its cost share obligation by funding the implementation of the channel and related basin from 250 feet south of Van Buren Street to the Gila River (a distance of 4.6 miles), and by being responsible for operation and maintenance of that portion of the Project. The State will fulfill its cost share obligation by funding the implementation of the channel and related features from Clearview Boulevard to 250 feet south of Van Buren Street (a distance of 15 miles), and by being responsible for operation and maintenance of that portion of the Project. This Agenda Item impacts Supervisory District 4. (C-69-10-056-3-00)

F-9. AMENDMENT TO IGA WITH THE ARIZONA DEPARTMENT OF TRANSPORTATION FOR THE SR303L DRAINAGE IMPROVEMENTS Approve Intergovernmental Agreement (IGA) Amendment One - FCD 2007A005A for the SR 303L Drainage Improvements (Project [#470]) between the Arizona Department of Transportation (State) and the Flood Control District of Maricopa County (District). This IGA Amendment identifies the responsibilities for project design, right-of-way acquisition, construction, construction management and operation and maintenance of an Inter-Connection segment for the Project at Van Buren Street. The estimated cost of the Inter-Connection segment is $726,000, which will be fully funded by the State and built by the District. This IGA Amendment also adds IGA provisions for right-of-way transactions of remainder-parcels of the Outfall portion from the District to the State. The estimated cost of the remainder parcels is $683,000, which is to be reimbursed by the State. The total expenditures and the total revenues of this Amendment are both estimated at $1,409,000. The IGA Amendment shall become effective upon signing and dating of the Determination Letter by the State Attorney General and shall remain in effect until completion of the construction of the Project. Operation and maintenance terms of the IGA Amendment shall survive the expiration of the IGA. The SR 303L/White Tanks Area Drainage Master Plan Update (ADMPU) was completed in 2005. The ADMPU’s recommendations included the construction of a regional 100-year drainage system adjacent to the future SR 303L freeway to intercept storm water flows, provide flood protection for the freeway, and convey flows to the Gila River. This entire Drainage System includes approximately 19 miles of channel and associated basins from Clearview Boulevard (north of Bell Road) to the Gila River along the proposed SR 303L freeway alignment. In accordance with the original IGA, the District will fund, construct, and maintain the segment of the Drainage System from 250 feet south of Van Buren Street to the Gila River (with a length of 4.6 miles), called the Outfall, while the approximately 14 miles of the Drainage System north of this segment are the responsibility of ADOT. This Agenda Item impacts Supervisorial District 4. (C-69-10-056-3-01)
