F-2. CONTRACT TO URS CORPORATION FOR CAVE BUTTES DAM MODIFICATION DESIGN AND ENGINEERING SUPPORT Award Contract FCD 2009C027, for the Cave Buttes Dam Seepage Remediation Project to URS Corporation for professional engineering services. Contract amount is a not-to-exceed amount of $800,000. The total contract performance is 1,095 calendar days from the date of approval by the Board of Directors. This is a qualifications-based selection in accordance with the Maricopa County Procurement Code, Article 5, Paragraph 504 and Article 5 Procurement Procedures Manual, Chapter II – Section 2. Cave Buttes Dam has not seen a full reservoir since constructed; however, a reservoir impoundment well below the spillway elevation produced seepage at the left abutment. This seepage and the lack of a downstream seepage control system raises dam safety concerns. In order to adequately mitigate this and other dam safety issues, a system of filter-drains with relief wells and an additional outlet are intended to be designed and constructed as reasonable and prudent dam safety modifications to the Cave Buttes Dam Project. Other measures to address dam safety issues may be identified and implemented as well as the design progresses. The final design work will also include landscaping and aesthetics within the project area where compatible with the safety and flood protection function of the project. This item impacts Supervisory District 3. (C-69-10-061-5-00)

F-1. CHANGE ORDER TO CONTRACT WITH URS CORPORATION FOR CAVE BUTTES DAM MODIFICATION DESIGN AND ENGINEERING SUPPORT Approve Change Order (CO) No. 4 to the Flood Control District of Maricopa County (District) Contract FCD 2009C027 – On-Call Cave Buttes Dam Modification Design and Engineering Support during Construction with URS Corporation (URS) in the amount of $1,300,000.00 for a total revised contract value of $2,500,000.00 and a contract duration increase of 730 days. On March 17, 2010, the Board authorized award of Contract Number FCD 2009C027 (C-69-10-061-5-00) under a qualification-based procurement. To date, URS has developed the project designs to approximately 30 percent. As such, URS is the only firm with sufficient project expertise to continue and complete the design. This requested action will increase the Contract Value from $1,200,000.00 to $2,500,000.00. This will allow additional funds to complete the design services of the Cave Buttes Modification project (Phase I). The project features in Phase I consist of constructing an additional outlet under Cave Buttes Dike No. 1 to reduce the maximum duration of the water impoundment on the upstream side of the dam from 61 days to 29 days. Cave Buttes Dam Project is located within the City of Phoenix and provides protection to property and citizens located downstream of the project in Cave Creek watershed to include parts of downtown Phoenix and the State Capital buildings. This change order also extends the contract period beyond the contractual period of 5 year to 7 years. The additional time is required because of complexities arising from the United States Corps of Engineers implementing a new permitting process for modifications to formerly federal funded projects. This process also requires more extensive review processes and additional layers of review. A.R.S.34-605 specifies that a contract for professional services entered into as the result of a procurement under section 34-603, 34-604 or 34-606 shall have a term not exceeding five years after the date of contract award by the agent of the first contract under the procurement, except that the contract may continue in effect after the five year term for professional services on projects on which the rendering of professional services commences within the five year term.
