F-4. IGA WITH MARICOPA COUNTY PARKS AND RECREATION FOR THE TRES RIOS TRAIL USE OF DISTRICT PROPERTY Approve Intergovernmental Agreement (IGA) FCD 2011A001 between the Flood Control District of Maricopa County (District) and the Maricopa County Parks and Recreation Department (County) for the Tres Rios Trail Use of District property. This IGA establishes the responsibilities whereby the County will utilize, operate and maintain Tres Rios Trail features on District property. The basis for this Agreement is IGA FCD 2006A002 approved by the District Board of Directors on August 23, 2007 which authorizes general recreation use of District property. There is no anticipated cost to the District associated with this IGA FCD 2011A001. The IGA shall become effective when executed by all parties. The U.S. Army Corps of Engineers and the City of Phoenix will design and construct trail and other recreation facilities as part of the Tres Rios project from 91st Avenue to 123rd Avenue (El Mirage Road). Certain trail components are proposed to be located on District property along the Tres Rios levee. These trail components will be incorporated into the Maricopa County Regional Trail System. The County will have the responsibility for the operation, maintenance and replacement of these trail components solely at their cost. Public safety associated with the use of the trail components will also be the responsibility of the County. This Agenda Item impacts Supervisorial District 5. (C-69-12-002-3-00)
