F-2. IGA WITH NATURAL RESOURCES CONSERVATION SERVICE FOR THE BUCKEYE FRS #1 REHABILITATION PROJECT Approve Intergovernmental Agreement (IGA) FCD 2011A004 for the Buckeye FRS No. 1 Rehabilitation (Project[#207]) between the Natural Resources Conservation Service (NRCS) and the Flood Control District of Maricopa County (District). The total estimated Project cost is $27,500,000. NRCS has determined that $6,070,257 of this amount is not eligible for federal cost share. This IGA establishes the cost-share for the design, land acquisition, construction, and operation and maintenance of the Project. The estimated total federally eligible project cost is $21,419,743, with the District’s estimated share being $7,409,203 and NRCS’s estimated share being $14,020,540. The IGA shall become effective when signed by the NRCS and shall expire five (5) years from the date of the signing by the NRCS. The period of performance on this agreement is from the point in time when it is fully executed by NRCS, until such time the rehabilitation of Buckeye FRS No. 1 is completed or September 30, 2017; whichever is earlier. Several dam safety deficiencies have been identified at Buckeye FRS No. 1 and overall rehabilitation of the dam best meets District goals and objectives related to dam safety and public safety. NRCS funding has not yet been appropriated for this IGA; future amendments to the IGA will report NRCS appropriations as they occur. This item impacts Supervisorial District 4. (C-69-13-005-D-00)

AMENDMENT TO IGA WITH U.S. DEPARTMENT OF AGRICULTURE NATURAL RESOURCES CONSERVATION SERVICE FOR BUCKEYE FRS NO. 1 REHABILITATION PROJECT Approve Amendment No. 1 to Intergovernmental (IGA) Agreement FCD 2011A004A, between the U.S. Department of Agriculture Natural Resources Conservation Service (NRCS) and the Flood Control District of Maricopa County (District) for the Buckeye FRS No. 1 Rehabilitation Project (Project[#207]). The purpose of this amendment is to add the federal cost share to this agreement of $4,000,000 towards the construction of Phase 1, for a total obligated federal cost share for this agreement to date of $4,000,000. The Amended IGA shall become effective when signed by both parties. Several dam safety deficiencies have been identified at Buckeye FRS No. 1 and overall rehabilitation of the dam best meets District goals and objectives related to dam safety and public safety. The purpose of this amendment is to add federal obligated funds to this Project in the amount of $2,250,000. With this increase, the current federally obligated amount to the project will be $6,250,000. The Amended IGA shall become effective when signed by both parties. Several dam safety deficiencies have been identified at Buckeye FRS No. 1 and overall rehabilitation of the dam best meets District goals and objectives related to dam safety and public safety. AMENDMENT TO IGA WITH U.S. DEPARTMENT OF AGRICULTURE NATURAL RESOURCES CONSERVATION SERVICE FOR BUCKEYE FRS NO. 1 REHABILITATION PROJECT Approve Amendment No. 3 to Intergovernmental (IGA) Agreement FCD 2011A004, between the U.S. Department of Agriculture Natural Resources Conservation Service (NRCS) and the Flood Control District of Maricopa County (District) for the Buckeye Flood Retarding Structure (FRS) No. 1 Rehabilitation Project (Project[#207]). The purpose of this amendment is to add federal obligated funds to this project in the amount of $17,974,200. With this increase, the current federally obligated amount to the project will be $24,224,200. The Amended IGA shall become effective when signed by both parties. Several dam safety deficiencies have been identified at Buckeye FRS No. 1 and overall rehabilitation of the dam best meets District goals and objectives related to dam safety and public safety. This amendment obligates additional NRCS funds for the project. In addition, this amendment requires that FCDMC reimburse NRCS for all assistance for this project. Terms of reimbursement will be established by a separate agreement. This item impacts Supervisorial District 4. (C-69-13-005-D-03)
