F-3. IGA WITH TOWN OF FOUNTAIN HILLS FOR ASHBROOK WASH DRAINAGE IMPROVEMENTS BAYFIELD DRIVE TO DEL CAMBRE AVENUE Approve Intergovernmental Agreement FCD 2014A007 for the Ashbrook Wash Improvements Project, Bayfield Drive to Del Cambre Avenue (Project [#670]), identifying and defining the responsibilities of the Flood Control District of Maricopa County (District) and the Town of Fountain Hills (Town), for activities and cost share related to the utility relocations, construction, construction management, operation and maintenance of the Project. This Agreement shall be effective as of the date it has been executed by both parties and shall expire five years from the date of recording, or upon Project completion, whichever is first to occur. The Fountain Hills Area Drainage Master Plan, completed in 1997, identified flooding hazards in the Town of Fountain Hills and recommended solutions, including the Project, to mitigate those hazards. Plans for the Project include the replacement of the culvert crossings at Bayfield Drive and Saguaro Boulevard and vegetation clearing in Ashbrook Wash. The Project’s estimated cost is $1.9 million, and project construction is expected to occur during calendar year 2015. This Agenda Item impacts Supervisorial District 2. (C-69-15-016-3-00)

BID AND AWARD FOR CONTRACT FOR ASHBROOK WASH IMPROVEMENTS Authorize the Chief Engineer and General Manager of the Flood Control District of Maricopa County (DISTRICT), through the Maricopa County Office of Procurement Services, to issue an Invitation for Bids for Contract FCD 2014C008 for the Ashbrook Wash Improvements (Project #670). Award the contract to the lowest responsible bidder(s) if the bid is not more than ten percent (10%) over the engineer’s estimate. The Fountain Hills Area Drainage Master Plan, completed in 1997, identified flooding hazards in the Town of Fountain Hills and recommended solutions, including the Project, to mitigate those hazards. Plans for the Project include the replacement of the culvert crossings at Bayfield Drive and Saguaro Boulevard and vegetation clearing in Ashbrook Wash. Based on the provisions of Intergovernmental Agreement (IGA) FCD 2014A007 (C-69-15-016-3-00) with the Town of Fountain Hills (TOWN), the DISTRICT will fund 50 percent of this construction contract and will provide the construction management. AMENDMENT TO AUTHORIZATION TO AWARD CONTRACT FOR ASHBROOK WASH IMPROVEMENTS Authorize the Chief Engineer and General Manager of the Flood Control District of Maricopa County (DISTRICT), through the Maricopa County Office of Procurement Services, to award the contract to the second lowest bidder, whose bid amount is 10.86% above the engineer’s estimate and is responsible and responsive in meeting the contract requirements. The original authorization for award of the contract requires that the award be to the lowest responsible bidder(s) if the bid is not more than ten percent (10%) over the engineer’s estimate. The apparent low bidder at 7.89% above the engineer’s estimate was found not to be fully responsive and responsible in meeting contract requirements. The Fountain Hills Area Drainage Master Plan, completed in 1997, identified flooding hazards in the Town of Fountain Hills and recommended solutions, including the Project, to mitigate those hazards.
