5. CHANGE ORDER 2 TO DESIGN PHASE SERVICES WITH GILBANE BUILDING COMPANY TO ADD CCIP Approve Change Order No. 2 to Contract C-70-08-022-5-00 with Gilbane Building Company of Phoenix, Arizona, for: (1) To the contract language to permit a change to the type of insurance for this project from an Owner-Controlled Insurance Program (OCIP) to a Contractor-Controlled Insurance Program (CCIP), and (2) In the amount not-to-exceed $6,600,000 as the lump sum premium due to Gilbane Building Company within 30 days of enrolling this project into the Gilbane Rolling CCIP program. The program is in the best interest of the County and is necessary in order to properly protect the County during the construction of this facility. Funds for this change order are within the approved budget. The Court Tower Project (Project No. 3325-07-380), located at the County’s Downtown Campus in Supervisorial District 5. An evaluation was conducted by Maricopa County , lead by Materials Management with participation from Risk Management, Facilities Management and the County Engineer , to determine the best and most cost-effective form of insurance coverage for the Court Tower Project (3325-07-380). Three forms of insurance coverage were evaluated: standard purchased insurance, Owner-Controlled Insurance Program (OCIP) and Contractor-Controlled Insurance Program (CCIP). After careful consideration of the three best offers, and the coverages afforded by each, the evaluation team determined that the CCIP coverage afforded the best coverage and pricing, resulting in an estimated saving of $180,000 over the next best coverage and price. 54. RIDER AND AMENDMENT TO CONTRACT WITH PARCOMM Approve "Rider and Amendment to January 4, 2008 Contract Between Parsons Commercial Technology Group, Inc. (PARCOMM) and Maricopa County," for the purpose of deferring the purchase of an OCIP insurance policy until at least the completion of the Design Development phase of the Court Tower project (3325-07-380), and requiring that the CMR, Gilbane Building Company, purchase and obtain an insurance policy(ies) to provide adequate coverage to the County. The Contract with PARCOMM, effective August 17, 2007, was approved by the Board of Supervisors on December 19, 2007. On December 19, 2007, the Board of Supervisors approved action C-70-08-022-5-00, which awarded the design phase services contract to Gilbane Building Company of Phoenix , Arizona , Contract No. FMD-07-041, in an amount not-to- exceed $2,000,000, effective July 30, 2007, for the design phase of the Downtown Court Tower . The actual design phase services contract with Gilbane Building Company, dated January 16, 2008, was signed by the Board of Supervisors on February 12, 2008. Section 4.2.2 of the General Conditions of the contract provided that an Owner Controlled Insurance Program (OCIP) be instituted by Maricopa County . At this time, the parties agree that it is more advantageous to the County and the project that the OCIP be deferred until the completion of the Design Development phase of the project and, in lieu of the OCIP, the contractor has put in place an insurance policy(ies) with the following limits: • CGL - $2,000,000; Encumbered Aggregate: $4,000,000 • Excess - $25,000,000 • E&O - None Gilbane Building Company provided certificates of insurance for this coverage within 20 days of approval of its Rider and Amendment on May 21, 2008, by the Board of Supervisors. The cost for this coverage was absorbed within the CMR's existing contract value. The project is located in District 5. (C-70-08-024-5-01)

69. CHANGE ORDER TO GILBANE BUILDING COMPANY DESIGN PHASE SERVICES CONTRACT FOR COURT TOWER Approve Change Order No. 5 to the Gilbane Building Company Design Phase Services Contract No. C-70-08-022-5-00 (FMD-07-041) in an amount not to exceed $925,000, to add furniture design and move management for the Downtown Court Tower Project (No. 3325-07380). The Downtown Court Tower is located in District 5. Change Order No. 5 adds scope to the existing contract to allow for the extensive furniture design and move management for the Downtown Court Tower Project. It was originally anticipated that this service would be handled by one of the three contracted firms for this project, but at the original time of contracting the Court Tower Team was uncertain as to which firm would provide the best service and product for the project and the County. The three firms, Gilbane Building Company, Gould Evans, and Parsons Technology were given the opportunity to vie for this scope of work. The Gilbane and Gould Evans firms teamed up to provide a comprehensive approach which complemented the work they were each already assigned. The team was selected by a committee of Public Works, Facilities Management Department and outside participants and was determined to be the best qualified to provide the best value for Maricopa County. A-4. CHANGE ORDER #9 TO GILBANE BUILDING COMPANY DESIGN PHASE SERVICES CONTRACT FOR DOWNTOWN COURT TOWER PROJECT Approve Change Order No. 9 to the Gilbane Building Company Design Phase Services Contract No. C-70-08-022-5-00 (FMD-07-041) in an amount not-to-exceed $14,565.00 to add management services for the moving services contract for the Downtown Court Tower Project (No. 3325-07-380). The Downtown Court Tower is located in District 5. Funding is available within the current project budget. Change Order No.9 adds scope to the existing contract to allow for the management of the moving services contract for the Downtown Court Tower Project. When the move management was added to this contract, the moving services were anticipated to be through the current County contract. However, the current moving contractor cannot manage a project of this size. The Downtown Court Tower team has determined that the most effective and efficient method of obtaining a moving service that can manage a project of this magnitude is through a separate procurement by the contractor. This addition in scope covers the procurement and management of the moving service contract. The moving company bidding and award will be made at a later date. (C-70-08-022-5-06)

73. CHANGE ORDER NO. 10 TO THE DESIGN PHASE SERVICES OF GILBANE BUILDING CO. FOR THE DOWNTOWN COURT TOWER Approve Change Order No. 10 to the Gilbane Building Company Design Phase Services Contract No. C-70-08-022-5-00 (FMD-07-041) in an amount not-to-exceed $121,922.00 to award the move service contract to Beltmann Relocation Group to facilitate the relocation of the Superior Court of Arizona to the Southeast Court Tower for the Downtown Court Tower Project (No. 3325-07-380). The Downtown Court Tower is located in District 5. Funding is available within the current project budget. Change Order No. 10 adds the award for services to the moving company as anticipated in Change Order No. 9. (C-70-08-022-5-07)
