65. ROAD USE AND GATE KEY AGREEMENT WITH PINNACLE WEST CAPITAL CORPORATION Approve and authorize the Chairman to execute all documents associated with a Shaw Butte Road Use and Gate Key Agreement with Pinnacle West Capital Corporation to allow the County to access the Shaw Butte communications site. This agreement allows Maricopa County the right to access the Shaw Butte communications site. The fee is $15.00 per gate key. During this agreement, the County will be required to comply with the Shaw Butte Users Association Constitution and Bylaws which may include financial participation on the part of the County toward maintenance and upkeep of the access road to the site. The funds for all fees and any road maintenance assessment during the development of a proposed County radio facility at the Shaw Butte site are contained within the County’s Radio System Upgrade Project budget.
