82. TOWER SUBLEASE AGREEMENT WITH DW TOWER, LLC FOR USE OF COMMUNICATION FACILITY AND BACKHAUL SYSTEM Approve, and authorize the Chairman to execute, a tower sublease agreement (L-7464) with DW Tower, LLC, (“DW Tower”) for the County’s development and operation of a wireless communications facility at Blue Point, and authorize the Chairman to sign all other documents approved by legal counsel required as part of the agreement for development and operation of a county wireless communication facility at the subject site. As part of the County’s Radio System Upgrade Project, the subject agreement with DW Tower allows the County use of a communication site and its backhaul system at a DW Tower facility located west of Saguaro Lake at Blue Point. The term of the agreement is ten (10) years. The monthly fee during this first year of the agreement is $2,850.00 (plus taxes and prorated expenses). The fee will escalate 3% per year thereafter. In addition to sales tax, the County will be financially responsible for its pro rata share of pass through expenses including such items as property tax increases, road assessments for ingress and egress to the Premises, and increases in electrical service directly attributed to the operation of the County’s equipment at the site. The start date for the 10-year term of the agreement will commence upon the earlier of: i) the start of construction at the site by the County; or ii) December 1, 2016. The commencement date will be adjusted in the event DW Tower is delayed in making the tower/site available to the County for the installation of the County’s equipment. (C-70-16-041-3-00)

50. ADMINISTRATIVE CHANGE TO RECOGNIZE NEW TOWER OWNER AND SUBLANDLORD UNDER LEASE L-7464 Approve an administrative change to Tower Sublease Agreement L-7464 to recognize SBA TOWERS IX, LLC, a Delaware limited liability company, as the new tower owner and successor Sublandlord with regards to the radio tower site located northwest of Usery Pass Road and Bush Highway. This item is located in Supervisors District 2. Pursuant to Section 15 of Tower Sublease Agreement L-7464, approved by the Board of Supervisors via C-70-16-041-3-00, the County received formal notice on March 30, 2018, that SBA TOWERS IX, LLC is the new tower owner and successor Sublandlord of the Tower Sublease Agreement via Bill of Sale. All rent payments and notices required under the sublease shall be sent to 8051 Congress Avenue, Boca Raton, FL 33487-1307. (C-70-16-041-3-01)
