110. AMENDMENT TO LICENSE AGREEMENT P-50314 FOR USE OF REAL PROPERTY Approve and execute Amendment No. 3 to Revocable License Agreement P-50314 with Ken Sheely Ranches Partners (“Licensee”) for Licensee’s restricted use of the County’s Southwest Justice Center site at 103rd Avenue and Van Buren in Avondale, Arizona (“Premises”). The Amendment will permit Licensee’s continued use of the Premises for farming from January 1, 2021 through December 31, 2021. The Premises area is reduced from 15.5 acres to 7.6 acres to accommodate laydown and material yard for the anticipated build-out of a MCSO substation at the north end. Licensee will pay an adjusted annual, non-refundable license fee of $456.00 for the use within 30 days of commencement. Licensee’s use will keep the property free of weeds and other noxious plants and Licensee will maintain the Premises in compliance with ordinances, regulations and statutes pertaining to airborne particulate matter. Either Party may terminate the Agreement with 180-day written notice to the other. (C-70-18-002-M-04)

AMENDED AND RESTATED REVOCABLE LICENSE AGREEMENT Approve and execute the Amended and Restated Revocable License Agreement (Agreement) between Maricopa County (County) and Ken Sheely Ranches Partners (Licensee) for Licensee’s use of County-owned property located at the northwest corner of 103rd Avenue and Van Buren Street in Avondale, Arizona for dust mitigation and farming. This Agreement supersedes all prior agreements between the parties. The term of the Agreement is for a period of approximately five (5) years, effective when executed by the County through December 31, 2027.
