75. 11064IGA-1, COMMUNICATIONS PRODUCT AGREEMENT & TRADE-IN AUTHORIZATION Approve a Communications Product Agreement between Maricopa County and Motorola Solutions, Inc. for the purchase of, and related services for, up to 3,475 radios (approximately 3,235 replacement & 240 new) in an amount not-to-exceed $16,193,476. In addition, authorize the trade-in of County owned radios being replaced as part of the purchase. Details of this purchase and the trade-in of County-owned radios are contained in the proposal from Motorola to Maricopa County, dated July 11, 2011 and amended on July 15, 2011. Pursuant to the Maricopa County Procurement Code, Section MC1-1004 and Title 41, Chapter 23, Article 10 of the Arizona Revised Statutes (A.R.S. § 41-2631, et seq.), Maricopa County has authority to procure materials, services, professional services, construction or construction services in accordance with a cooperative purchasing agreement with another public procurement unit. Specifically, A.R.S. § 41-2634 provides that if a public procurement complies with the requirements of procurement statutes, then any public procurement administered by a cooperative purchase agreement is deemed to have complied with the procurement statutes. Maricopa County has executed cooperative purchasing IGA with the City of Yuma (C-73-05-002-2-00), and is accessing the City of Yuma executed Communications System Agreement No. 03-13042/RES, as amended, with Motorola for integrated wireless mobile data solutions.
