LETTER OF INTENT AND FUNDS TRANSFER TO PURCHASE REAL PROPERTY Approve execution of a Letter of Intent to the State of Arizona, acting through its Department of Transportation, for the purchase of real property, identified as APN 139-49-001Y and APN 139-49-001M, for the purchase price of One Million Three Hundred Fourteen Thousand Nine Hundred dollars ($1,314,900) plus one-half (1/2) of the escrow fees and closing costs which are estimated not to exceed two thousand dollars ($2,000). Approve a transfer from General Fund (100) to General Fund County Improvements (445) in the amount of $1,316,900. Direct the Budget Office to amend the 5-year Capital Improvement Plan to add two new projects: NPA1 - Purchase of North Parcel APN 139-49-001Y SPA1 – Purchase of South Parcel APN 139-49-001M Also, in accordance with A.R.S. §42-17106(B), authorize the following adjustments to the FY 2019 budget: 1) Decrease expenditures in the Non Departmental (D470) General Fund (100) Non Recurring Non Project (NRNP) Contingency (4711) Unreserved Contingency line by $1,316,900. 2) Increase the Non Departmental (D470) General Fund (100) Non Recurring Non Project (NRNP) Capital Improvements Projects (4713) budgeted expenditures by $1,316,900. 3) Increase the Non Departmental (D470) General Fund County Improvements (445) Non Recurring Non Project (NRNP) revenue budget by $1,316,900. 4) Approve offsetting revenue and expenditure adjustments for the fund transfer in the Eliminations (D980) Eliminations Fund (900) Non Recurring Non Project (NRNP). 5) Increase Non Departmental (D470) General Fund County Improvements Fund (445) Purchase of North Parcel (NPA1) expenditure authority $931,000. 6) Increase Non Departmental (D470) General Fund County Improvements Fund (445) Purchase of South Parcel (SPA1) expenditure authority by $385,900. The approval of this action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. Approve These two properties are adjacent to the County’s Southeast Campus and were formerly occupied by the State of Arizona Motor Vehicle Department. The south building is partially occupied by the Arizona Department of Revenue (ADOR) via a lease agreement. It is anticipated that the lease will be assigned to the County at closing and that ADOR will relocate from the property by January 30, 2019. (C-78-19-002-3-00)

And authorize the Chairman to sign all other documents approved by legal counsel required to purchase the parcels. This item is located in Supervisor District 2. On August 29, 2018 the Board authorized the Chairman to execute a Letter of Intent to purchase APN 139-49-001M and 139-49-001Y (located adjacent to the County’s Southeast Regional Campus) from the State of Arizona for the purchase price of $1,314,900 (C78-19-002-3-00) plus closing costs not to exceed $2,000. 54. ADDENDUM TO PURCHASE AGREEMENT WITH THE STATE OF ARIZONA Approve and authorize the Chairman to execute Addendum No. 1 to Terms of Excess Land Purchase Agreement and Receipt for Deposit executed on October 22, 2018 (C-78-19-002-3-01) by and between the State of Arizona, acting through its Department of Transportation, and Maricopa County, for the purchase of APN 139-49-001M and 139-49-001Y. The purpose of this Addendum is to extend, at no additional cost to the County, the escrow closing date to May 1, 2019 to allow the State additional time to vacate the properties before the County takes title to the properties, thus eliminating the need for the assignment of lease; and to rescind the Assignment and Assumption of Lease executed on October 19, 2018 by and between the State of Arizona, acting through its Department of Transportation, and Maricopa County. This item is located in Supervisory District 2. On August 29, 2018 the Board authorized the Chairman to execute a Letter of Intent to purchase APN 139-49-001M and 139-49-001Y (located adjacent to the County’s Southeast Regional Campus) from the State of Arizona for the purchase price of $1,314,900 (C78-19-002-3-00) plus closing cost not to exceed $2,000. On October 10, 2018, the Board authorized the Chairman to execute all documents to consummate the sale and transfer of the two (2) parcels to Maricopa County (C-78-19-002-3-01). An Assignment and Assumption of Lease was executed as part of the required documents to convey the State-owned land to the County. (C-78-19-002-3-02)
