40. IGA WITH GILA COUNTY Approve and authorize the Chairman to execute, Intergovernmental Agreement (IGA) G-30211 with Gila County to allow Gila County to install, operate, and maintain Gila County-owned communications equipment on the Maricopa County owned tower at Mt. Ord. This item is located in Gila County and adjacent to Supervisory District Two. Maricopa County owns a communication tower that was built atop Mt. Ord in accordance with a Communications Use Lease from the United States Forest Service (USFS). Gila County owns, operates, and maintains a communication facility adjacent to the County’s site at Mt. Ord. This IGA will allow Gila County, at its sole cost and expense, to install, operate, and maintain Gila County-owned communication equipment (if space is available) on Maricopa County’s tower to increase the public safety benefit to Gila County. The term of the IGA is ten (10) years and it can be renewed for up to three (3) periods of five (5) years each upon mutual agreement. In consideration of the increased public safety benefit provided by this co-location, Gila County’s use of the space on Maricopa County’s tower is free of charge. The IGA may be terminated: (1) at the end of any fiscal year due to non-appropriation of funds without any penalty; (2) by written notice for cause or for no cause at least twelve (12) months prior to the effective date of such termination; or (3) for either party’s failure to cure a default as specified in the IGA.
