56. AGREEMENT WITH U.S. ENVIRONMENTAL PROTECTION AGENCY (EPA) Approve an Agreement between the US Environmental Protection Agency (EPA) and Maricopa County through the Air Quality Department, in the not-to-exceed amount of $200,000. This Agreement is funded by a grant from the US through the EPA (00T82501). The purpose of this Agreement is to identify and establish a near-road Nitrogen Dioxide (NO2) monitoring site. This Agreement is effective from June 1, 2012 until May 31, 2014. Authorize the Air Quality Director or Deputy Director to sign all documents related to these grant funds. The grant allows a 26% rate for indirect costs, or up to $11,349 which may be incurred by the Air Quality Department or Maricopa County for the administration of this grant. The Maricopa County Department of Finance has calculated the Air Quality Department’s composite indirect cost rate at 26%, or $11,349. The award does include equipment and installation expenses of $145,000 which are excluded from the indirect cost recovery. The recoverable indirect cost of administering this grant is $11,349; the non-recoverable indirect cost is $0. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. A budget adjustment is not required. (C-85-13-007-G-00)
