21. AGREEMENT WITH U.S. DEPARTMENT OF HOMELAND SECURITY FOR BIOWATCH PROGRAM Approve an Agreement between the United States Department of Homeland Security (DHS) and Maricopa County through the Air Quality Department, in the not-to-exceed amount of $531,034. This Agreement is funded by a grant from the DHS (Award Number 06OHBIO00003-15-00) with the purpose of continuing funding for the fifteenth year of the BioWatch program. This award ID# 06OHBIO00003-15-00 increases the federal funding by $177,011 with the remainder of the funding expected to be released in a subsequent amendment. The BioWatch program includes an ambient air monitoring network to sample air pollution in a variety of settings, assess health and welfare effects, assist in determining sources of air pollution; and to carry out the provisions of the US EPA, the Federal Clean Air Act and Amendments, Arizona Revised Statutes, and County Air Pollution Control Regulations that are intended to correct, remove, minimize or prevent air pollution within Maricopa County. The Agreement is effective from September 1, 2006 until February 28, 2021, while the budget is retroactively a ten-month grant, effective from May 1, 2020 until February 28, 2021. Project budgets were applied for annually but for the next year, this grant will be funded on a ten-month grant cycle. EPA states the BioWatch program will return to 12-month budget periods starting with the FY’21 award cycle. The FY2020 Air Quality composite indirect rate of 23.40% will be applied to the direct charges of $404,404 The recoverable indirect cost of administering this grant is $94,630; the non-recoverable indirect cost is $0. The award includes equipment expenses of $32,000 which are excluded from the indirect cost recovery. The grant award is reoccurring and has been awarded to the department in previous years. The cash or in-kind match is not applicable, indirect cost is fully recoverable, ongoing cash contributions not applicable. The grant award is not mandated, and the activities are 100% financially supported by the grant from Department of Homeland Security (DHS). The Air Quality Department works with DHS to protect the citizens of Maricopa County by operating a network of biological samplers. The grant award is non-competitively bid. There are no costs that will need to be absorbed by the departments operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. A budget adjustment is not required. Maricopa County Air quality is responsible for the daily collection of the ambient air quality samples for the BioWatch Program within Maricopa County. The DHS has dedicated a portion of its budget to be used for funding under the “Homeland Security BioWatch Program: Field Operations & Sample Collection Activities.” (C-85-16-012-G-04)
