16. AQ-2017-009: MARICOPA COUNTY AIR POLLUTION CONTROL REGULATION III - RULE 350; RULE 351; RULE 352; RULE 353 Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to solicit comments on the proposed revisions of Maricopa County Air Pollution Control Regulation III – Rule 350 (Storage and Transfer of Organic Liquids (Non-Gasoline) at an Organic Liquid Distribution Facility), Rule 351 (Storage and Loading of Gasoline at Bulk Gasoline Plants and Bulk Gasoline Terminals), Rule 352 (Gasoline Cargo Tank Testing and Use), and Rule 353 (Storage and Loading of Gasoline at Gasoline Dispensing Facilities) and the associated proposed revision to the Arizona State Implementation Plan (SIP). Following the public hearing, the Board is requested to adopt the proposed revisions to the rules and to approve submission of the revised rules as a revision to the Arizona SIP. Rule 350 limits emissions of volatile organic compounds (VOCs) from organic liquids (non-gasoline) during the storage and transfer of an organic liquid at an organic liquid distribution facility. Rule 351 limits emissions of VOCs from gasoline during the storage and loading of gasoline at bulk gasoline plants and at bulk gasoline terminals. Rule 352 limits emissions of VOCs from gasoline cargo tanks. Rule 353 limits emissions of VOCs during storage and loading of gasoline at a gasoline dispensing facility. The MCAQD is proposing to revise Rules 350, 351, 352, and 353 to address rule deficiencies identified by the Environmental Protection Agency (EPA). The proposed revisions are required to secure the rules’ approval as part of the Arizona State Implementation Plan under the federal Clean Air Act. The MCAQD is also proposing revisions to address rule recommendations provided by the EPA, incorporate revisions recommended by stakeholders, and make other revisions to improve and clarify the rules.
