67. AGREEMENT FCD 2021G001 AMONG THE FLOOD CONTROL DISTRICT AND MARICOPA COUNTY AND DIAMONDBACK SAND AND ROCK NORTH, LLC, AND RESOLVE CONSENT JUDGMENT ON CV 2019-015408 Approve and authorize the Chairman to execute Agreement FCD 2021G001 among The Flood Control District of Maricopa County and Maricopa County and Diamondback Sand and Rock North, LLC for Resolution of Outstanding Violations Involving APN 201-22-008B. On May 26, 2020, a Consent Judgment was entered in the matter of Maricopa County v. Brown, CV 2019 015408. The Consent Judgment provided for agreed upon penalties and a compliance schedule for Planning and Development, Air Quality and Flood Control violations. Although some progress has been made in resolving the violations, the Brown’s have contended that they lack the funds to bring the property into compliance. The Browns are now under contact with Diamondback Sand and Rock North, LLC for the conveyance of the property. Closing of escrow is pending. Diamondback has been made aware of the violations on the property and has negotiated with Maricopa County and the District to bring the property into compliance. This agreement will resolve all issues in this matter and will replace the existing Consent Judgment. This item was heard in the April 5, 2021 Executive Session. (C-85-21-040-X-00)
