22. AGREEMENT WITH US ENVIRONMENTAL PROTECTION AGENCY AIR POLLUTION CONTROL PROGRAM CLEAN AIR ACT SECTION 105 GRANT Approve an Agreement between the US Environmental Protection Agency and Maricopa County through the Air Quality Department in the not-to-exceed amount of $1,130,617. This agreement is funded by a grant from the US Environmental Protection Agency, Award ID# A00905222. This assistance agreement provides full funding. This agreement is retroactively effective from October 1, 2021, to September 30, 2022. The FY2022 Air Quality composite indirect rate of 19.75% will be applied to the direct charges of $944,148. The recoverable indirect cost of administering this grant is $186,469; the non-recoverable indirect cost is $0. The grant award is reoccurring and has been awarded to the department in previous years. The cash or in-kind match is not applicable, indirect cost is fully recoverable, ongoing cash contributions not applicable. The grant award is mandated by the EPA Clean Air Act, Section 105. The grant award is noncompetitively bid. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation; therefore, expenditures of these revenues are not prohibited by the budget law.
