36. MEMORANDUM OF AGREEMENT - DELEGATION OF AUTHORITY OF THE FEDERAL PLAN FOR EXISTING MUNICIPAL SOLID WASTE LANDFILLS Approve the Memorandum of Agreement for the Delegation of Authority of the Federal Plan for Existing Municipal Solid Waste (MSW) Landfills between the Maricopa County Air Quality Department (MCAQD) and the United States Environmental Protection Agency (EPA). The EPA encourages states that do not have approved 111(d) plans to request delegation of authority of the Federal Plan so they can have primary responsibility for implementing the 2016 municipal solid waste landfill emission guidelines until a 111(d) plan is approved. Following Board approval in September of 2022, MCAQD submitted a delegation of authority request to implement the Federal Plan for Existing MSW Landfills to the EPA. The EPA drafted a Memorandum of Agreement incorporating the delegation of authority requirements and it must be signed by the Chairman of the Maricopa County Board of Supervisors. The Federal Plan and corresponding delegation of authority will no longer apply upon the effective date of the approved 111(d) plan for Maricopa County. (C-85-23-057-X-00)
