35. WITHDRAWAL OF THE ARIZONA STATE IMPLEMENTATION PLAN (SIP) SUBMITTAL TO REMOVE RULE 41 (MONITORING) FROM THE SIP AND REPLACE IT WITH RULE 245 (CONTINUOUS SOURCE EMISSION MONITORING) The Maricopa County Air Quality Department (MCAQD) requests approval to withdraw the May 4, 2023 SIP submittal requesting the rescission of Rule 41 from the Arizona SIP and approval of Rule 245 into the Arizona SIP. On April 26, 2023, the Maricopa County Board of Supervisors adopted revisions to Rule 245 and approved submittal of the revised rule into the Arizona SIP as a replacement for Rule 41 as a revision to the Arizona SIP. On May 4, 2023, MCAQD through the Arizona Department of Environmental Quality submitted the SIP revision to the U.S. Environmental Protection Agency (EPA). In July 2023, EPA recommended that MCAQD withdraw the SIP submittal since the revised Rule 245 only applies to nitric acid plants, sulfuric acid plants, and fluid bed catalytic cracking units and is not required to fulfill EPA SIP requirements. In addition, EPA advised that Rule 41 can be removed from the SIP without replacement because it is not required to fulfill EPA SIP requirements and is duplicative to other provisions in the Arizona SIP.
