35. AGREEMENT WITH ARIZONA DEPARTMENT OF ENVIRONMENTAL QUALITY Approve a Government Services Contract (GSC) (EV25-0037) agreement between the Arizona Department of Environmental Quality (ADEQ) and Maricopa County Air Quality Department (MCAQD) in the not-to-exceed amount of $846,661. The purpose of this agreement is to support Air Quality Department program efforts. This Agreement and budget are effective from July 1, 2025, until June 30, 2026. The FY2025 MCAQD indirect cost rate of 36.10% will be applied to the direct charges of $671,661. Per the ADEQ award agreement, the indirect cost of administering this grant is $178,156 and is allowable and fully recoverable. An amount of up to $175,000.00 will be passed through to the Regional Public Transportation Authority as an external service provider upon separate agenda and approval for services provided between July 1, 2025, and June 30, 2026. The County will retain the amount of $671,661. The grant award is reoccurring and has been awarded to MCAQD in previous years. The cash or in-kind match is not applicable, and ongoing cash contributions are not applicable. This grant award is a mandated function of the MCAQD per Arizona Revised Statutes (ARS) §49-581 et seq. The grant award is noncompetitively bid. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation; therefore, expenditures of these revenues are not prohibited by the budget law.
