43. AMENDMENT TO LEASE AGREEMENT NO. L-7322 WITH CITY OF PHOENIX Approve and authorize the Chairman to execute, Amendment No. 3 to Ground Lease No. L-7322 with the City of Phoenix as Lessor, for the County’s use of land at 1260 S. 7th Avenue, Phoenix. The County leases a parcel of City of Phoenix owned land at 1260 S. 7th Avenue where a County-owned modular WIC facility is located. The County also is financially responsible for all utilities and repairs to the WIC facility. The current lease will expire December 31, 2011. Amendment No. 3 to Lease L-7322 will extend the term of the ground lease through December 31, 2014 with one addition three-year renewal option remaining. The annual rental fee for the subject ground lease is $1.00. (C-86-03-066-4-04)

NOTICE OF OPTION TO RENEW GROUND LEASE FOR WIC SITE ON 7TH AVENUE Approve, and authorize the Chairman to execute Option to Renew No. 4 to Ground Lease No. L-7322 with the City of Phoenix, as Lessor, for the County’s use of land at 1260 S. 7th Avenue, Phoenix. AZ 85007. The County leases a parcel of City of Phoenix owned land at 1260 S. 7th Avenue, Phoenix, where a County-owned modular trailer Public Health WIC facility is located. The County is financially responsible for all utilities and repairs to the facility. The current lease will expire December 31, 2014. Option to Renew No. 4 to Lease L-7322 will extend the term of the ground lease through December 31, 2017 with no renewal options remaining. The annual rental fee for the subject ground lease is $1.00. (C-86-03-066-4-05)

57. DECLARE AS EXCESS FOR DISPOSITION COUNTY PERSONAL PROPERTY (LEASE L-7322 FOR WIC SITE ON 7TH AVENUE) Pursuant to A.R.S. §11-251, the Maricopa County WIC program requests the Board of Supervisors declare as excess and authorize the sale or demolition of six (6) (2- 16’ x 56’ and 4- 14' x 56’) Phoenix Modular units (personal property), serial numbers PMI-2976-01, PMI-2976-02, PMI-2976-03, PMI-2976-01, PMI-2976-05 & PMI-2976-06 (the “Modulars”) located at 1260 S. 7th Avenue, Phoenix, AZ. If sold, a bill of sale document for the units will be presented to the Board of Supervisors for acceptance and signature after auction. Maricopa County owns six (6) Modulars which were purchased on behalf of its Department of Public Health Women, Infants, and Children (WIC) Program and installed on City of Phoenix land located at 1260 S. 7th Avenue in 2011 via a land lease (L-7322, C-86-03-066-4-00). The City of Phoenix is selling the property and will not be renewing the County’s lease. WIC will be vacating the Modulars on or before the termination of their lease on December 31, 2017. The Modulars are excess to County needs and can be made available for disposition pursuant to A.R.S. §11-251. If declared excess by the Board, the Modulars will be offered for sale at market value at public auction (as determined by appraisal), or, with unanimous consent of the board, without auction, to another government agency or to a solely charitable, social or benevolent nonprofit organization incorporated or operating in this state for a specific use. There will be a one-time appraisal fee of $2,400.00 (previously paid), as well as a one-time fee of approximately $95,859 to prepare the units for auction (deskinning, utility disconnect and capping, removing ‘sheet’ roof etc.) and to perform the necessary site restoration work after the auction. In the event that the auction is unsuccessful and the Modulars are not sold, the additional estimated cost for demolition of the Modulars is $26,771. (C-86-03-066-4-06)
