78. IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR TOBACCO EDUCATION AND PREVENTION SERVICES Approve an Intergovernmental Agreement (IGA) between the Arizona Department of Health Services (ADHS14-072483) and Maricopa County by and through its Department of Public Health for Tobacco Education and Prevention Services. This IGA provides funding in the not-to-exceed amount of $2,211,225 for budget term July 1, 2014 through June 30, 2015. The contract term is July 1, 2014 through June 30, 2017. The Department of Public Health’s indirect rate for FY14-15 is 14.8%. ADHS only allows for 15% of Personnel Services and Employee Related expenses in the amount of $1,369,601.00. The full indirect costs are estimated at $285,071 of which $205,440 is recoverable and $79,631 is unrecoverable. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Funding for this Agreement is provided by a Grant from ADHS and will not affect the County’s general fund. (C-86-15-002-3-00)

47. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR TOBACCO EDUCATION AND PREVENTION SERVICES Approve Amendment No. 1 to Intergovernmental Agreement (IGA) Contract No. (ADHS14-072483), Tobacco Education and Prevention Services (TEPS), between the Arizona Department of Health Services and Maricopa County by and through its Department of Public Health to extend the term and revise, replace and add, additional provisions. The IGA will be amended, effective date of the final signature unless otherwise specified as follows: 1. Pursuant to Special Terms and Conditions, Provision Four (4) Contract Administration and Operation 4.2, Contract Renewal, the Contract is hereby extended through June 30, 2018. 2. Pursuant to Terms and Condition of the Agreement, Provision Six (6), Contract Changes, Item 6.1, Amendments, Purchase Orders and Change Orders; Terms and Conditions, Provision Seventeen (17), Health Insurance Portability and Accountability Act of 1996 (HIPAA) is revised and replace with Provision Seventeen (17) of this Amendment One (1). 3. Pursuant to Terms and Conditions of the Agreement, Provision Six (6), Contract Changes, Item 6.1, Amendments, Purchase Orders and Change Order; Provisions Twenty (20), The Federal Funding Accountability and Transparency Act (FFATA or Transparency Act – P.L. 109-282, as amended by section 6202(a) of P.L. 110-252), is hereby added to the Terms and conditions. 4. Pursuant to Terms and Conditions of the Agreement, Provision Six (6), Contract Changes, Item 6.1, Amendments, Purchase Orders and Change Order; Provisions Twenty (21) Contracting; Procurement; Investment; Prohibitions, is hereby added to the Term and Conditions. All other provisions of this agreement remain unchanged. (C-86-15-002-3-02)

This amendment completes the 5 year term with the period from July 1, 2018 through June 30, 2019. The contract term is July 1, 2014 through June 30, 2019. There is no additional funding connected to this budget period. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law.
