38. FACILITY USE REVOCABLE LICENSE AGREEMENT WITH ST. MARY’S FOOD BANK ALLIANCE FOR WIC CLINIC SPACE Approve, and authorize the Chairman to execute, Facility Use Revocable License (FURL) Agreement No. P-50264, with St. Mary’s Food Bank Alliance (SMFB), for use of space at three (3) Maricopa County through its Department of Public Health, Women, Infant and Children (WIC) clinics. The Agreement will allow SMFB to provide a Summer Meal Service Program to presenting youth under the age of 18 at the Public Health/WIC facilities. The agreement term will begin June 1, 2015 and expire August 7, 2015, unless terminated earlier as provided for in the agreement. The space will consist of lobby. There is no cost to the County or presenting clientele. Either Party may terminate the Agreement with 30 days’ notice to the other Party. The three (3) WIC facilities are: 1) Glendale, 5141 W. Lamar Rd, AZ 85301 2) Mesa, 430 N Dobson, Mesa, AZ 85201 3) St. Mary’s, 3003 W. Thomas Rd., Phoenix, AZ 85017 This FURL also allows for SMFB the use of clinic spaces at the WIC facilities as scheduled on Exhibit “A”. County agrees to provide access without remuneration. Also, re: Article 4. County Responsibilities, 4.3., the Public Health Director of Maricopa county, or their designee, is given the authority to execute an Exhibit “B” to change the specific dates, times and locations when use and parking are required, provided there is no cost to the County as a result of the change, at the sole discretion of the PH Director which may be unreasonably withheld. This general type of Real Estate action was endorsed by the Facilities Review Committee during August of 2013. (C-86-15-097-M-00)
