59. AGREEMENT FOR DATA SHARING WITH TUBERCULOSIS EPIDEMIOLOGIC STUDIES CONSORTIUM Approve the ‘Data Sharing Agreement’ between Tuberculosis Epidemiologic Studies Consortium (TBESC) and Maricopa County by and through its Department of Public Health (MCDPH). This is a non-financial agreement between the parties. The term of this Agreement shall become effective January, 2018 and shall continue to be in effect until September 30, 2022. The TBESC recognizes its responsibility, to the public and the scientific community, to encourage scientific progress as rapidly and judiciously as possible using its data resources. To take full advantage of such resources and maximize their research value, it is important that the collected data be made available, on appropriate terms and conditions, to investigators in a timely manner. The purpose of this Agreement is to comply with the requirements of the Health Insurance Portability and Accountability Act of 1996 (42 USC §1320d et seq.) (“HIPAA”), the Health Information Technology for Economic and Clinical Health Act (“HITECH”) of the American Recovery and Reinvestment Act of 2009 (ARRA), which made changes to various provisions of HIPAA, privacy and security regulations set forth at 45 CFR Parts 160 and 164 (the “HIPAA Rules”) and any applicable state confidentiality laws.
