94. PURCHASE ORDER FROM ARIZONA DEPARTMENT OF HEALTH SERVICES HIV PREVENTION AND RYAN WHITE PART B SERVICES Approve a retroactive Purchase Order (PO) for the HIV Intergovernmental Agreement (IGA) ADHS18-188819 between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH). The PO provides funding with a not to exceed amount of $818,400 for the Ryan White Part B portion for the budget period 4/1/22 through March 31, 2023. The IGA term is January 1, 2018 through December 31, 2022. This HIV Prevention grant award is reoccurring and has been awarded to the department in previous years. It is non-competitive and there is no cash or in-kind match required. The grant award is a mandated function, should it be discontinued on-going contributions may be required. This grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 15% of salaries and employee related expenses. The Department of Public Health’s indirect rate for FY23 is 17.24%. Total indirect expenses are estimated to be $122,688.83 of which $106,747.83 is not recoverable and will be absorbed by the departments operating budget. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. The purpose of these funds is to assist MCDPH implement a comprehensive high impact HIV Prevention Program in Maricopa County. The goals are to provide access to quality HIV testing and Linkage to Care (HTL) for persons residing in Arizona, to conduct partner services (PS) expanded testing activities, and to provide PS in public and private sectors to all persons newly diagnosed with HIV or previously positive with a new sexually transmitted disease (STD) diagnosis, and to all HIV positive persons or their medical providers requesting continuing PS. 32. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR HIV PREVENTION AND RYAN WHITE PART B SERVICES Approve amendment number 3 for IGA ADHS18-188819 for the HIV Prevention and Ryan White Part B (RWPB) Program between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH). This amendment provides funding with a not to exceed amount of $800,000 for Component C of the IGA for the budget period August 1, 2022 through July 31, 2023. The HIV Prevention portion has a not to exceed amount of $280,000 for budget period January 1, 2022 through December 31, 2022. The RWPB portion is in the not-to-exceed amount of $821,400 for the budget period April 1, 2022 through March 31, 2023. The IGA term is January 1, 2018 through December 31, 2023. Effective upon signature by all parties and pursuant to the Terms and Conditions, Provision Six, (6), Contract Changes, Section 6.1, Amendments, Purchase orders and Change orders, it is mutually agreed that the Intergovernmental Agreement referenced is amended as follows under this amendment three (3 ); 1.1 The Scope of Work is revised and replaced; and 1.2 The Price Sheet is revised and replaced. The not-to-exceed total of this amendment is $1,901,400. This HIV Prevention grant award is reoccurring and has been awarded to the department in previous years. It is non-competitive and there is no cash or in-kind match required. The grant award is a mandated function, should it be discontinued on-going contributions may be required. This grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 15% of salaries and employee related expenses for the RWPB & Component C portion and the HIV portion has no indirect allowed. The Department of Public Health’s indirect rate for FY23 is 17.24%. Total indirect expenses are estimated to be $284,242.67 of which $211,486.96 is recoverable and $72,755.71 is not recoverable and will be absorbed by the departments operating budget. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. Funding for this Agreement is provided by a Grant from ADHS and will not affect the County’s general fund. (C-86-18-051-3-08)

95. IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR HIV COMPONENT C PREP/NPEP NAVIGATION SERVICES Approve Intergovernmental Agreement (IGA) (CTR065198) between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH) to provide funding for services related to Pre-Exposure Prophylaxis (PrEP) and non-occupational Post Exposure Prophylaxis (nPEP) for persons receiving Sexually Transmitted Infection (STI) and HIV testing at the MCDPH STD Clinic. The price sheet/fee schedule is in the not-to-exceed amount of $800,000 for the budget period August 01, 2023, through July 31, 2024. The term of this agreement is from January 01, 2024, through December 31, 2029. Component C was previously included under ADHS18-18819 and now ADHS is breaking out Component C to have its own contract. Component C was added under C-86-18-051-3-08. This non-competitive grant award is reoccurring and has been awarded to the department in previous years. There is no cash or in-kind matching requirement. Should the grant cease, ongoing contributions are not required. This grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 15% indirect cost reimbursement as delegated in the IGA. MCDPH’s indirect rate for FY24 is 15.65. The full indirect costs are estimated at $108,869.57 of which$104,347.83 is recoverable and $4,521.74 is unrecoverable. Program costs not covered by the grant will be subsidized by the MCDPH indirect cost pool. The grant award is not a mandated function but provides a benefit to the citizens by providing education in accordance with the program. Board Required Information: Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Funding for this Agreement is provided by a grant from ADHS and will not affect the County’s general fund. (C-86-24-003-X-00)
