42. PURCHASE ORDER FOR IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR JUSTICE TOBACCO CESSATION PROGRAM Approve a retroactive Purchase Order (PO) No. PO0000177083 for Intergovernmental Agreement (IGA) Contract No. (ADHS18-203283), Justice Tobacco Cessation Program between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH), Office of Healthcare Innovation (OHI) to provide funding for OHI to develop a pilot project plan to address tobacco use among adults in Maricopa County’s justice system. This PO provides funding in the not to exceed amount of $200,000 for budget term July 1, 2019 through June 30, 2020. The contract term is July 1, 2018 through June 30, 2023. The grant award was a competitive grant, reoccurrence is unknown and there is no cash or in-kind match required. The grant award is not a mandated function but provides a benefit to the citizens by reducing commercial tobacco use with tobacco cessation intervention services. The Department of Public Health’s Indirect Rate for FY 2019-20 is 19.2%. Total indirect expenses based on full award are estimated to be $33,391. Per this IGA, the indirect costs shall not exceed 15% of total personnel and employee related expenses, therefore $26,087 is recoverable and $7,304 is unrecoverable. Indirect costs not recoverable will be subsidized by the MCDPH indirect cost pool. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Funding for this Agreement is provided by a Grant from ADHS and will not affect the County’s general fund. (C-86-18-101-3-01)
