41. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR CLINICAL SERVICES CAPACITY PROGRAM Approve additional funds for the Intergovernmental Agreement (IGA) Contract No. CTR043100, HIV Surveillance Capacity Expansion Program, between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH). The additional amount is $12,563.37 for a total not-to-exceed amount of $204,563.37 for the budget period January 1, 2022 through December 31, 2022. The term of the original contract is April 1, 2019 to March 31, 2024. This was a new IGA with a 5 year term. It may reoccur but it is uncertain. Neither cash nor in-kind match is required and the need for ongoing cash contributions is not anticipated. The grant award services are not a mandated function. This was not a competitive process. The Department of Public Health’s indirect rate for FY 2022 is 17.97%. Total indirect expenses are estimated to be $1,914 all of which is recoverable. All program costs are allocated to the grant so there should be no additional burden on the department’s operating budget. (C-86-19-057-3-05)

77. PURCHASE ORDER WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR ENHANCED SURVEILLANCE CAPACITY PROGRAM Approve a retroactive Purchase Order (PO) 649238 for Intergovernmental Agreement (IGA) CTR043100, Enhanced Surveillance Capacity Program, between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH). The PO is in the amount of $56,000.00 for the period of January 01, 2024, through March 31, 2024. This brings the total not-to-exceed amount to full in the amount of $204,563.37, for the contract period of April 01, 2019, through March 31, 2024. This grant award has been awarded to the Department for several years, however, it is unknown if it will go beyond the current five (5) year term as a new IGA has not been presented at this time. Neither cash nor in-kind match is required and the need for ongoing contributions is not anticipated. This grant award was non-competitive and is not a mandated function. This grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 10%. The full indirect costs are estimated at $8,038.55 of which $5,090.91 is recoverable and $2,947.64 is unrecoverable. Program costs not covered by the grant will be subsidized by the MCDPH indirect cost pool. Departmental indirect rates are re-established at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. (C-86-19-057-3-07)
