55. IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR DOMESTIC MEDICAL EXAMINATIONS FOR LEGAL NEWLY ARRIVED REFUGEES Rescind the action approved by the Board on January 10, 2024 for item C-86-24-126-X-00, the Intergovernmental Agreement (IGA) between the Arizona Department of Economic Security (ADES), and Maricopa County by and through its Department of Public Health (MCDPH), to provide grant funding for Domestic Medical Examinations (DME) for legal newly arrived refugees resettling in Maricopa County. The rescind action is necessary due to ADES not signing the contract due to an increase in budget from $500,000 to $950,000. Also approve the revised IGA DI24-002411 between ADES and Maricopa County by and through its Department of Public Health (MCDPH) to provide grant funding for DMEs for legal newly arrived refugees resettling in Maricopa County. The not-to-exceed amount is $950,000.00 for a period of 12 months to begin on the date of the last authorized signature and not exceed a period of 5 years without mutual agreement of extension. The Department of Health’s indirect rate for FY24 is 15.65%. Indirect costs are estimated at $67,661.05 all of which is recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year and future indirect rates will be collected at the corresponding rates. This grant has been awarded to MCDPH in the past, but it is unknown if it will be awarded again. It is non-competitive and there is no cash or in-kind match required. The services this grant provides are not mandated functions but provide valuable benefits to the community. A Business Associate Agreement is attached to this IGA for use and disclosure of confidential information, including information designated as protected health information and all other confidential or sensitive information. AMENDMENT TO CONTRACT WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY Approve a retroactive Amendment One (1) by and through the Arizona Department of Economic Security (ADES) and Maricopa County by and through its Department of Public Health (MCDPH) for Intergovernmental Agreement (IGA) DI24-002411 for Domestic Medical Examination (DME) for legal newly arrived refugees resettling in Maricopa County. Effective upon signature, it is mutually agreed that the Intergovernmental Agreement referenced is amended as follows: 1. PURSUANT TO THE INTERGOVERNMENTAL AGREEMENT (IGA) SECTION 17 AMENDMENTS, THE PARTIES HEREBY AGREE TO AMEND THE AGREEMENT AS FOLLOWS: 1.1 The Itemized Service Budget for the period October 1, 2024, through September 30, 2025, is being added. The Agreement reimbursement ceiling is $950,000.00. Section 14.0 Exhibit A - Itemized Service Budget is attached. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR DOMESTIC MEDICAL EXAMINATIONS Approve a retroactive Amendment Two (2) by and through the Arizona Department of Economic Security (ADES) and Maricopa County by and through its Department of Public Health (MCDPH) for Intergovernmental Agreement (IGA) DI24-002411 for Domestic Medical Examinations (DME) for legal newly arrived refugees resettling in Maricopa County. The Department of Health’s indirect rate for FY26 is 16.69%. Indirect costs are estimated at $75,633.49 all of which is recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year, and future indirect rates will be collected at the corresponding rates. This grant has been awarded to MCDPH in the past, but it is unknown if it will be awarded again. It is non-competitive and there is no cash or in-kind match required. The services this grant provides are not mandated functions but provide valuable benefits to the community. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Funding for this Agreement will not affect the County’s General Fund.
