26. RIGHT OF ENTRY AND ACCESS AGREEMENT FOR AN AIR QUALITY MONITOR AT PHOENIX WELL SITE #94 Approve and execute Right of Entry and Access Agreement for an Air Quality Monitor at Phoenix Well Site #94, No. P-50295, with the City of Phoenix, (Licensor) for use of City property for an Air Quality Monitor site at 8351 N. 6th Street, Phoenix, Arizona 85020. This Agreement is a continuation of and is one of five sites authorized in C-88-03-022-2-00. The Agreement will allow continued use of City property for air quality monitoring and equipment site consistent with requirements of the Federal Clean Air Act. The term of the Agreement will commence upon signatures of both Parties and expire five (5) years later. By mutual written agreement of both Parties the term may be extended for two (2) five (5) year option periods. Either Party may terminate the Agreement with a thirty (30) day written notice to the other. The County may terminate the Agreement pursuant to A.R.S. § 38-511 or for non-appropriation of funds (C-85-18-012-M-00)
