123. IGA WITH ADHS FOR PROPOSITION 201 SMOKE FREE ARIZONA ACT Approve an Intergovernmental Agreement (IGA) between Arizona Department of Health Services (ADHS) and Maricopa County through the Environmental Services Department, in the not-to-exceed amount of $900,000. The purpose of this Intergovernmental Agreement is to implement education and report compliance of Proposition 201 Smoke Free Arizona Act. This Intergovernmental Agreement is effective from July 1, 2009 until June 30, 2010. Pursuant to A.R.S. 42-17105, Intergovernmental Agreement revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. 53. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR PROP 201 SMOKE FREE ARIZONA ACT Approve Amendment No. 5 to an Intergovernmental Agreement between Arizona Department of Health Services and Maricopa County through the Environmental Services Department in the not-to-exceed amount of $688,500.00. The purpose of this amendment is to decrease the annual funding by $76,500 and add an additional line of the Price Sheet titled "Estimated Quarterly Amount" in the amount of $172,125.00. This amendment is effective from July 1, 2010 to June 30, 2011. All other terms and conditions of the Intergovernmental Agreement remain in full force and effect. (C-88-09-010-3-01)
