25. DELEGATION AGREEMENT WITH THE ARIZONA DEPARTMENT OF ENVIRONMENTAL QUALITY FOR DELEGATION ALLOWS ONE GOVERNMENTAL ENTITY TO PROVIDE STATE AND COUNTY REGULATORY SERVICES Approve an Intergovernmental Agreement between Arizona Department of Environmental Quality (ADEQ) and Maricopa County through the Environmental Services Department (MCESD), for the purpose of Delegation allows one governmental entity to provide State and County regulatory services in Maricopa County. The Delegation Agreement #EV12-0057 will be effective upon approval by all parties and expires on June 30, 2050. This Intergovernmental Agreement is non-financial and is effective from March 27, 2013 until June 30, 2050. Upon BOS approval, Delegation Agreement# EV12-0057 will replace Delegation Agreement # 06-0024, which currently exists between ADEQ and the MCESD. The Delegation Agreement renews MCESD authority to act for ADEQ for specified public water supply, wastewater and solid waste regulations. (C-88-13-005-3-00)

33. IGA WITH ARIZONA DEPARTMENT OF ENVIRONMENTAL QUALITY TO DELEGATE AUTHORITY TO ONE GOVERNMENTAL ENTITY TO PROVIDE STATE AND COUNTY REGULATORY SERVICES Approve an amendment to an Intergovernmental Agreement between the Arizona Department of Environmental Quality (ADEQ) and Maricopa County Environmental Services (MCESD). Delegation agreement #EV12-0057 which was approved on March 27, 2013, C Number: C-88-13-005-3-00, and effective through June 30, 2050. The amendment adds a footnote to the Delegated Functions and Duties pertaining to the investigation of used oil disposal to land, stating that the delegation "is limited to disposal of nominal amounts up to 50 gallons at any on non-generator location". The Delegation Agreement #EV12-0057 will be effective upon approval by all parties and expires on June 30, 2050. This Intergovernmental Agreement is non-financial and is effective through June 30, 2050. (C-88-13-005-3-01)

29. AMENDMENT TO DELEGATION AGREEMENT WITH ARIZONA DEPARTMENT OF ENVIRONMENTAL QUALITY Approve an Amendment to Agreement No. EV12-0057 between Arizona Department of Environmental Quality (ADEQ) and Maricopa County Air Quality Department (MCAQD) and Environmental Services Department (ESD) to delegate authority to the MCAQD to administer permitting under ADEQ's regulations. Both the State and Maricopa County have amended its non-attainment New Source Review permitting requirements. On April 22, 2016 the Board of Supervisors approved the rule revisions. However, the Environmental Protection Agency (EPA) has not yet incorporated the new rules into the State Implementation Plan (SIP). This agreement allows MCAQD delegated authority to use ADEQ regulations until the EPA incorporates the updated County rules into the SIP. (C-88-13-005-3-02)
