EROP CASE ES-2021-001/2017 FOOD CODE INCORPORATION BY REFERENCE Pursuant to A.R.S. §11-251.05 and A.R.S. §36-184(B)(5), set a public hearing for October 6, 2021 to solicit comments and consider the adoption of EROP Case ES-2021-001/2017 Food Code Incorporation by Reference. Upon Board approval, this item will become effective. Proposed revisions incorporate the 2017 FDA Food Code and annexes by reference and eliminate references to earlier versions, while removing MCEHC language in conflict with the 2017 FDA Food Code. The new 2017 FDA Food Code and annexes contain the latest food safety practices. In addition, this proposal provides a consistent, statewide regulatory framework that will reduce stakeholder confusion between agencies because both Maricopa County and the State will have adopted the FDA 2017 Food Code and annexes. The Governors Regulatory Review Council approved the 2017 FDA Food Code and annexes, which the State adopted in June 2020. This MCEHC revision proposal is following Maricopa County’s EROP policy.
