59. SETTLEMENT OF CLAIM BY TITAN POWER INC. Approve a settlement of the claim by Titan Power Inc. in the amount of $9,899.62. This action will settle all claims between the parties for work authorized by a work order request to replace 60 Uninterruptible Power Supply (UPS) batteries in the Maricopa County Department of Transportation’s Engine Room. A request was made of Titan Power to replace 60 UPS batteries in the Department of Transportation’s Engine Room. The company satisfactorily performed all services requested on the work order request. Before the company performed this work, they were on the State of Arizona contract EPS070086A. However, due to the misunderstanding of the Procurement Code of Maricopa County, the work was requested of an Arizona State contract vendor rather than the Maricopa County contract vendor. All work has been performed satisfactorily and no known problems exist. The settlement amount of $9,899.62 is the actual value of the services performed and completed. Supervisorial Districts 1, 2, 3, 4, and 5. This item was discussed in Executive Session on November 6, 2008. (C-91-09-063-M-00)
