38. PRODUCTION BASED RENEWABLE ENERGY CREDIT PURCHASE AGREEMENT WITH ARIZONA PUBLIC SERVICE COMPANY FOR DURANGO JUVENILE DETENTION FACILITY BUILDING NO. 1713 Approve a Solar Renewable Energy Credit Purchase Agreement (CPA) between Maricopa County and Arizona Public Service (APS) Company. Under the terms of this agreement, APS commits to purchasing certificates representing the Environmental Attributes associated with the energy produced by the rooftop solar thermal hot water system to be installed on the Durango Juvenile Detention Facility (Building #1713). In turn, Maricopa County commits to producing a specified amount of solar energy on an annual basis for 20 years. In the event that the County does not produce the specified amount of energy, the County has the obligation under the CPA to pay APS for the deficiency. The actual cost of such deficiency would be the difference between the contract price and the price for APS to purchase credits elsewhere. Installation of this system will be completed under the Energy Savings Services Contract with APS Energy Services. Funding for this project has already been established and budgeted. ADMINISTRATIVE CORRECTION TO A SOLAR RENEWABLE ENERGY CREDIT PURCHASE AGREEMENT Approve an administrative correction to a Solar Renewable Energy Credit Purchase Agreement (CPA) between Maricopa County and Arizona Public Service (APS) Company (C-91-10-186-3-00) to reflect the correct term of the contract from 20 years to 15 years. The original item stated the period would be 20 years, but the correct number of years for this contract is 15 years. (C-91-10-186-3-01)
