93. IGA WITH THE CITY OF PHOENIX FOR IMPROVEMENTS T0 35TH AVENUE FROM BASELINE ROAD TO SOUTHERN AVENUE Approve the Intergovernmental Agreement (IGA) between Maricopa County and the City of Phoenix for Improvements to 35th Avenue from Baseline Road to Southern Avenue. The City plans to improve 35th Avenue from Baseline Road to Southern Avenue, and approximately 90% of the Project is located within a “County Island” and the City desires to enter into this IGA with the County to acquire the necessary right-of-way. The County will be reimbursed for all costs associated with acquiring the necessary right-of-way for the City. Funds are available in the Public Works Department (910) Transportation Capital Projects Fund (234) Right-of-Way (RWAY) Project. Sub-Project T011, ROW In-Fill/Road Inventory System, will be used to account for the expenditures on this project. The City will upon acquisition of the ROW, initiate the formal annexation process for the roadway within the Project area. Once the City receives the construction notice to proceed, they will assume responsibility and liability for construction, operation and maintenance of the roadway within the Project area until the formal annexation process is complete.
