90. SETTLEMENT: CASE NO. CV2009-016281, MERITAGE HOMES OF ARIZONA, INC./MERITAGE HOMES CONSTRUCTION, INC. (“MERITAGE HOMES”) Authorize the Chairman to execute consideration and vote regarding settlement of Case No. CV2009-016281, Meritage Homes of Arizona, Inc./Meritage Homes Construction, Inc. This agreement resolves all claims and liabilities between the parties. Maricopa County through the Maricopa County Department of Transportation (MCDOT) will receive a total of $410,000 as part of the settlement agreement. This item was heard and discussed in a Board of Supervisors Executive Session on Monday, September 13, 2010. Supervisor District No. 1 (C-91-11-069-S-00)
