54. CHANGE ORDER TO CONTRACT WITH MARKHAM CONTRACTING COMPANY FOR THE EL MIRAGE ROAD PHASE B, BELL ROAD TO DEER VALLEY DRIVE Approve Change Order No. 23 to Contract No. 2009-036 with Markham Contracting Co., Inc., in the amount of $133,272.11 for the El Mirage Road – Phase B, Bell Road to Deer Valley Drive, Maricopa Association of Government Arterial Life Cycle Program (ALCP) Project, Sub-Project No. T103. The following items were brought to Maricopa County Department of Transportation’s (MCDOT) attention by the Contractor after construction was complete in October 2010 and this change order provides settlement and equitable compensation for extra work as found justified through MCDOT evaluation of each item. 1) Over excavation of unsuitable material; 2) Standby time for work in the Bell Road channel; 3) Bell Road channel shotcrete sealant; 4) Median regrading due to Intelligent Transportation System (ITS) alignment redesign; 5) Box culvert outlet backfill completion in south McMicken Wash crossing; 6) Bell Road intersection closure expenses; 7) Expenses for traffic control changes; 8) Overtime expenses for weather delays; 9) Additional bond payment for the Flood Control District of Maricopa County (FCDMC) permit extension; 10) Placement of box culvert fill material. This change order will pay all direct costs associated with each item, is full and just compensation for each item, and completely settles each issue including all indirect costs and all ripple effects associated with these issues.
