57. BID AND AWARD FOR ROADWAY IMPROVEMENTS OF NORTHERN PARKWAY BETWEEN SARIVAL AVENUE AND DYSART ROAD Approve the solicitation of bids for the first phase of roadway improvements to Northern Parkway between Sarival Avenue and Dysart Road, Maricopa Association of Governments Arterial Life Cycle Program (ALCP) Project, Sub-Project T195. Also, approve the award of the contract to the lowest responsive bidder provided that the lowest responsive bid does not exceed the Engineer’s Cost Estimate by more than 10 percent. This project is located along the new Northern Parkway alignment generally beginning along Sarival Avenue between Northern Parkway and Olive Avenue along the Butler Drive alignment and continuing to the intersection of Dysart Road and Northern Avenue. The project is located in Maricopa County and the Cities of El Mirage and Glendale, Arizona. The work consists of 4 miles of new roadway construction on the new Northern Parkway alignment; new connections from Sarival Avenue, Reems Road and Litchfield Road to Northern Parkway; intersection improvements; drainage and channels; lighting; bridge over Burlington Northern Santa Fe (BNSF) railroad; bridges over Sarival Avenue; Intelligent Transportation System (ITS) pluming; signing and pavement markings; and traffic signals. A-1. SETTLEMENT AND MUTUAL RELEASE AGREEMENT, AND CHANGE ORDER NO. 39 TO CONTRACT 2011-025 WITH LAWRENCE CONSTRUCTION COMPANY Approve the Settlement and Mutual Release Agreement between Maricopa County and Lawrence Construction Company (LCCO) pursuant to the terms in the agreement resolving all remaining claims. In addition, consistent therewith, approve Change Order No. 39 to Contract 2011-025 (C-91-11-180-5-00) with Lawrence Construction Company (LCCO) in an amount of $319,260.00 for the Northern Parkway - Sarival Avenue to Dysart Road Project , Project No. TT195. Change Order No. 39 rescinds 102 days of liquidated damages per final negotiations between MCDOT and Lawrence Construction Company (LCCO), and as a result establishes a new completion date after the original April 18, 2013 contract completion date. LCCO’s request for a time extension associated with the MSE Wall design and construction is denied. This change order provides full and complete compensation for settlement of all claims in accordance with the Settlement and Mutual Release Agreement included as Attachment “A” to Change Order No. 39. The two major issues that are addressed and resolved with the Settlement and Mutual Release Agreement are as follows: 1) 243 days of liquidated damages (LD’s) and traffic control charges assessed, as required by the contract, against the contractor for the delayed completion of project, and; 2) the holdback of $198,085.35 of contract funds, as required by the US Department of Labor (DOL), for unpaid fringe benefits owed by one of LCCO’s subcontractors, Tierra Contracting, Inc., to its employees. As additional background, during the first half of 2014 (after Dec. 2014 project completion) LCCO and MCDOT worked together to negotiate and execute Change Order No. 38 which resolved nearly all of the project issues, except for the LD’s and DOL holdback.
