52. INTERGOVERNMENTAL AGREEMENT G-30176 WITH THE TOWN OF PARADISE VALLEY FOR COST SHARING OF PUBLIC SAFETY RADIO COMMUNICATIONS FACILITY Approve, and authorize the Chairman to execute, all documents associated with Intergovernmental Agreement G-30176 (“IGA”) with the Town of Paradise Valley (the “Town”) for Cost Sharing of the Paradise Valley Public Safety Radio Communication Facility for the acquisition, construction, installation, maintenance and operations of a public safety radio communications facility at a Town-provided site. This IGA allows Maricopa County the right to share in the development of a public safety radio communications facility which will provide the County needed public safety radio coverage as well as radio coverage for the County’s other government purposes. The initial term of the IGA will be for 25 years with an option to renew for an additional 25 years. The County and the Town will equally share in the costs for: i) acquiring the site and/or scheduled payments associated with acquiring rights to the site; ii) the costs of developing the shared components of the communications facility; and iii) the ongoing operation and maintenance costs for the subject communications facility. The Town and the County will be individually responsible for each party’s individual costs associated with procurement, installation, start-up, operation and maintenance of each party’s own radio system equipment at the subject facility. The County will have a one-time right to terminate the IGA upon completion of the Town’s full assessment of the costs associated with acquiring the site and/or rights to access the site. A subsequent Board of Supervisors’ agenda item will be submitted for the Board’s consideration upon completion of the Town’s assessment of the site acquisition costs. This IGA will support the implementation of the County’s Radio System Upgrade Project. (C-94-15-003-3-00)

66. AMENDMENT TO COST SHARING IGA WITH TOWN OF PARADISE VALLEY FOR PUBLIC SAFETY RADIO COMMUNICATION FACILITY Approve and authorize the Chairman to execute, Amendment No. 1 to Intergovernmental Agreement (IGA) G-30176 with the Town of Paradise Valley (“Paradise Valley”) for Cost Sharing of the Paradise Valley Public Safety Radio Communication Facility. Amendment No. 1 to IGA G-30176 will provide for the termination of the subject IGA upon full execution of the Amendment. The right of Paradise Valley to use the County’s Contract 12030-RFP P25 Radio Communications Systems with Motorola Solutions, Inc. will survive the termination of the subject IGA so long as the subject contract is an active contract between the County and Motorola Solutions, Inc. A key component of Amendment No. 1 is that neither party is financially responsible to the other party for the costs incurred by either party during the vetting process of the Paradise Valley Facility and the Paradise Valley Site.
