46. TRANSFER AND RELEASE AGREEMENT WITH THE ARIZONA RAILWAY MUSEUM Pursuant to A.R.S. §11-251.9, approve, and authorize the Chairman to execute, a Transfer and Release Agreement with The Arizona Railway Museum (the “Museum”), an Arizona non-profit corporation, for the assignment, transfer, and conveyance of certain railroad rails, ties, spikes, and associated equipment (the “Railroad Equipment”) to the Museum and to provide the Museum with limited access to the County-owned facility at 1920 S. Lewis Street in Mesa for removal of the Railroad Equipment. THIS ITEM REQUIRES UNANIMOUS CONSENT OF THE BOARD. The County’s Facilities Management Department has determined that the Railroad Equipment is of no financial benefit to the County. Removal of the Railroad Equipment by the Museum and re-installation of the removed items at the non-profit’s museum will provide a benefit to the community. As part of the Transfer and Release Agreement, the Museum will be responsible, at the Museum’s sole cost and expense, for safe and compliant removal of the Railroad Equipment from the County’s facility. The term of the agreement is for 90-days from the date the agreement is executed by the Chairman. (C-94-15-023-3-00)
